I. General Terms and Conditions

1. Business rules:

By submitting your order and accepting these General Terms and Conditions, you will become a customer of Garuda Trade Ltd. Please read the following information before each purchase.

The seller: In case of each product, the seller is Garuda Trade Ltd.

Subject of the contract: The subject of the contract is a human and/or veterinary product selected by the buyer in the online store of Garuda Trade Ltd. All our products have the necessary official licences. For detailed information on each product, please refer to the product description or read the package leaflet. Ownership of the products passes to the buyer upon receipt of the product, provided that the buyer has paid the purchase price in full.

The content indicated on the website, especially the information used to describe the products, does not result in a binding nature for Garuda Trade Ltd, but they serve the purpose of presentation, and the images on the website are only illustrations. Any content sent to the customer by any means of communication (electronic, telephone, etc.) or obtained by the customer through accessing, visiting and/or browsing the website does not constitute a contractual obligation of Garuda Trade Ltd, nor does it constitute an obligatory bid and/or offer, in relation to this content.

 

  1. Methods of payment of the purchase price

Purchase price, terms of payment: The price shown next to the products is the gross consumer price, which also includes value added tax (27%).

The customer compiles the shopping cart to be purchased in the Webshop, selects the shipping method, provides delivery information in case of home delivery, and then indicates the desired payment method in the methods of payment section.

The purchase price can be paid in the following ways:

a) In cash: only available in case of personal collection, or as cash on delivery at the parcel point pickup location.

c) Payment by credit card: available in case of home delivery, delivery to a parcel point, and personal collection.

Our webshop also offers its customers payment via credit card provided by Budapest Bank Zrt.

 Credit card payment process:

After selecting the credit card payment method, the customer will be redirected to the bank's payment server. The card details must be entered on the payment page that appears. (The redirection is necessary so that the credit card data to be handled with great security is not provided and stored by the web store operator, but by the bank.)

After entering the card data, the customer (transaction) is authenticated, and in case of successful authentication, the transaction is processed.

Garuda Trade Ltd. only receives information related to the order from customers, not the credit card data, while Budapest Bank only handles the card data required for the payment transaction on the encrypted payment page.

 

3D Secure Security Solutions:

As a partner of secure online payment, Budapest Bank uses the 3D Secure, MasterCard SecureCode and Verified by VISA solutions - developed by MasterCard and Visa card companies -, known as a new generation of online security solutions, so that the customer of the online store can feel safe at all times. Using the 3D Secure protocol, the customer is protected by the PIN code provided by the cardholder for online purchases during transactions, and the connection is established directly with the system of the accepting bank for all online transactions. d) Cash on delivery: only available in case of home delivery and delivery to a parcel point services.

In case of home delivery, the GLS courier service will deliver the parcel to the delivery address provided by the buyer, and the buyer can pay to the courier in cash upon receipt of the order. The cash on delivery fee is HUF 1,090 gross, which includes the delivery cost and is added to the final amount of the invoice.

 

e) Delivery to abroad: only avaiblale for home delivery.

Foreign payments can be made via bank transfer or by credit card payment.

The following shipping costs will be added to the final invoice for European shipments via GLS courier:

  • Denmark, France, Vatican City, Italy, Great Britain, Monaco, Ireland: HUF 6,065 or EUR 17.30
  • Lithuania, Latvia, Spain, Sweden, Estonia, Norway, Greece, Portugal, Finland: HUF 8,830 or EUR 25.30
  • Serbia, Bosnia and Herzegovina, Montenegro, Iceland, Albania, Macedonia, Malta, Turkey, Andorra, Gibraltar, Kosovo, Faroe Islands, Cyprus: HUF 22,260 or EUR 63.60

  1. Terms of delivery and deadlines:

In case of home delivery, the expected delivery time is 2-5 working days from the placing of the order. We may not be able to fulfill your order due to an unexpected shortage of stock. If a longer delivery time is expected than the above, we will always notify you via e-mail.

Delivery can be done in the following ways: 

 

a) Delivery to a GLS parcel point:

In case of delivery to a GLS parcel point, GLS courier service will deliver the parcel to the parcel point of your choice, the fee of which is HUF 1,190 gross, which will be added to the final amount of your invoice. When the parcel is posted, GLS will notify the recipient by email that the package will be delivered the next business day. The e-mail contains the parcel number.

In case of a purchase above HUF 15,000 gross, delivery to a parcel point is free of charge, and the cost of delivery is not to be paid by the buyer, but by Garuda Trade Ltd.

In the case of delivery to a GLS parcel point, GLS courier service delivers the goods to the parcel point selected by the customer on the working day following the dispatch. GLS will inform the recipient via SMS that the parcel has arrived at the GLS parcel point. The shipment can be picked up at any time within 5 working days after the notification, taking into account the opening hours of the parcel collection points. Cash-on-delivery parcels can be paid for in cash at the selected parcel point upon receipt.

b) Home delivery by GLS courier service:

In case of bank transfer, credit card payment, and cash on delivery, GLS courier service will deliver the package to the address provided by the customer. GLS delivers to the buyer's home or workplace, they do not deliver to a mailbox address. We recommend that you provide a shipping address where you can be reached during the day. Please provide the right telephone number when placing the order, so that we can contact you if there are any problems with the delivery. When the parcel is posted, GLS will notify the recipient by email that the package will be delivered the next business day. The e-mail contains the parcel number.

After crediting the buyer (with the exception of cash on delivery), the goods will be handed over to GLS courier service for delivery. The cost of delivery by GLS, which is added to the final amount of your invoice, is HUF 1190 gross.

In case of domestic delivery, and in case of the amount of one purchase above HUF 15,000 gross, the delivery is free of charge, and the cost of delivery is not to be paid by the buyer, but by Garuda Trade Ltd.

Flexible delivery service:

GLS courier service provides three delivery attempts. The first delivery attempt in depot cities can be requested after business hours as well between 5 pm and 8 pm. When the parcel is dispatched, GLS will notify the recipient by email that the package will be delivered the next business day. The email will include the parcel number and the amount of any cash due on delivery. On the morning of the day of delivery, the recipient will be notified of the courier’s phone number, the GLS Customer Service phone number, and a 3-hour time window of the expected delivery. If the delivery attempt fails, an email notification will be sent to the recipient. Through the link provided in the e-mail, the recipient can record a delivery order, in which he can request delivery at a new time, to another address, or request the personal pick-up of the parcel from a GLS Parcel Point selected from a specific list.

 

Unsuccessful delivery:

The cost of resending the parcel as a result of failed delivery due to the fault of the buyer will always be borne by the buyer.

 

c) Personal collection:

We will notify you of the receipt of your order, and when the order is ready for collection by e-mail.

In case of personal collection, after notifying the customer, we can store the products for 10 working days, after which we cancel the order from the system.

Garuda Trade Ltd. reserves the right to delete the order from the system (after letting the buyer know) if it is unable to deliver the products ordered.

Garuda Trade Ltd. may, at its own discretion, decide to perform partial delivery, and to deliver any products affected by the product shortage at a later date. If this happens, the buyer will not incur any additional costs, Garuda Trade will only charge the delivery fee once.

 

Partial orders

Our webshop does not allow for partial ordering, we handle each order separately. Limitation of liability:

Garuda Trade Ltd. is not responsible for possible damages, especially in the following cases:

  • In the event of a malfunction that prevents you from joining our website, and place an order there.
  • Damage due to any hardware or software failure of your computer, or damage due to loss of Internet connection. Please note that in order to use the Internet safely, you need to protect yourself against viruses that spread online.

 

  1. Personal data:

The service provider (Garuda Trade Ltd.) must act according to the 2016/679 EU Council and Parliament Regulation on the protection of individuals with regard to the processing of their personal data and on the free movement of such data, as well as on repealing EC Regulation 95/46 (on General Data Protection Regulation), and also according to the provisions of Act CXII/2011 on the right of self-determination of information and freedom of information.   1. Using the Webshop
    a) Logging in, loggin out, registration:

Orders can be placed through the web store as a registered customer or as a guest (without registration). You do not have to register in our store before you start your purchase. However, we recommend registration because from the second order you can manage your purchases much faster and more conveniently. To register, please provide your name, shipping address, billing address, phone number, and email address. After registration, you will receive a confirmation email in your email account, which you can activate by clicking on the link provided in it. After registration, our system will enter you into our store. If you have already registered but forgot your password, click on the password reminder button and then enter your registered e-mail address, to which our system will automatically send you the password. If your information has changed in the meantime, you can change it at any time by clicking the Settings tab. The Log Off button is required if you are browsing the Internet from a place where others can use the same computer. By logging off you can prevent someone from ordering from us on your behalf.

 

b) Shopping Cart: Click the Shopping Cart button to view its contents, the products you have put together for purchase. You can edit the contents of the basket as you wish.

 

c) Placing an Order:

You can order the selected products in the Cart function. Click the Checkout button to check the products in your cart and change your billing and shipping information. You have the option to enter a separate shipping and billing address. You can then finalize your order by clicking the Submit Order button. We will send you an automatic notification by e-mail when the order is received. The system will then begin the actual processing of your order. Orders are fulfilled while stocks last. The contract will be concluded with a substantive confirmation sent to you no later than 48 hours. The language of the contract is Hungarian, unless the ordering process is in English - in which case the language of the contract is English. Please be informed that the contract to be concluded does not constitute a written contract. Garuda Trade Ltd. registers the concluded contract, the contract is available for 2 years from its fulfillment, we will send it to you again if required.

 

d) Right of withdrawal / cancellation:

Pursuant to the rules of Government Decree 45/2014 (II.26.), you have the right to withdraw from the contract without giving a reason within 14 days.

The withdrawal / cancellation period

(a) (in the case of a contract for the sale of a product) expires 14 days after the date on which you or a third party other than the carrier designated by you takes over the product;

(b) (in the case of the supply of several products) expires 14 days after the date on which you or a third party other than the carrier designated by you takes over the last product.

If you wish to exercise your right of withdrawal / cancellation, you must send a clear statement of your intention to withdraw / terminate (for example by post, fax or e-mail) to the following address:

For this purpose, you may also use the sample withdrawal / cancellation notice attached as Annex 1 to these General Terms and Conditions.

In case of withdrawal, you are obliged to return (by post/courier service or in person) the product to Garuda Trade Ltd. without undue delay, but no later than within 14 days from the notification of your statement of withdrawal. The deadline is considered to have been met if you return the product before the 14-day deadline.

Pursuant to Section 29 of Government Decree 45/2014, the right of withdrawal may not be exercised in respect of a perishable products or products which preserve their quality for a short time, or in respect of a sealed product which, for reasons of health protection or hygiene, cannot be returned after its opening. Due to the fact that most of our products fall into the health and hygiene category, you are not able to return a product if the seal is broken and the package has been opened.

 

  1. Resolution of Disputes

We know very well that online purchases are made on a trust basis, which is why we handle all complaints quickly, within 5 business days, and send you information via email.

If any consumer dispute between the Seller (Garuda Trade Ltd.) And the Buyer is not settled during the negotiations with the Seller, the following enforcement possibilities are open for the Buyer:

- Complaints filed with consumer protection authorities.

If the Buyer notices a violation of consumer rights, he is entitled to file a complaint with the competent consumer protection authority of his place of residence. Following the assessment of the complaint, the authority shall decide on the conduct of the consumer protection proceedings.

- Conciliation Board

The Buyer may initiate proceedings before a conciliation board for the out-of-court settlement of consumer disputes relating to the quality, safety of the products and the application of product liability rules and the conclusion and performance of the contract. The name and registered office of the conciliation board according to the registered office of Garuda Trade Ltd. is: Budapesti Békéltető Testület 1016 Budapest, Krisztina krt. 99. III. em. 310.

- Judicial proceedings

The Buyer is entitled to enforce his claim arising from the consumer dispute in court within the framework of civil proceedings in accordance with the provisions of the Civil Code and Act CXXX of 2016 on the Code of Civil Procedure.

 

The Seller's obligations with respect to supplies, product warranties and guaranties are set forth in Appendix 1.

  1. Copyright Information

The content and design elements of all pages and sub-pages of the webshop are under the copyright protection of Garuda Trade Ltd, so their complete or partial copying, modification or use for any purpose is not permitted. The information displayed on the pages may be disclosed in full or in part only with the written consent of the service provider.

The content, as defined in these General Terms and Conditions, includes in particular, but not limited to, the logos, graphics, trademarks, images, videos, animations, multimedia texts and / or any other content displayed on the website. All this is expressly the property of Garuda Trade Ltd, and Garuda Trade Ltd. reserves all rights in this regard.

Buyers may download, copy, or use the content, or any portion thereof, solely for personal use, in accordance with the provisions of these General Terms and Conditions. In addition to personal use, the buyer is not entitled to copy, distribute, communicate, transfer to third parties, modify and / or otherwise change, use, or place the Content in any other context than the original, without the express written consent of Garuda Trade Ltd.

Any content to which the buyer has access or obtains access by any means is subject to these General Terms and Conditions.

 

  1. Law Applicable

Hungarian law shall govern these General Terms and Conditions and the individual contracts concluded on the basis thereof.

Garuda Trade Ltd. reserves the right to update the General Terms and Conditions of the website or to amend them from time to time, to reflect the way and conditions of operation of the website, or any change in the legal environment. In such cases, a modified version of the General Terms and Conditions will appear on the site. The content of the General Terms and Conditions should be monitored from time to time on the website. The buyer may object to the General Terms and Conditions after their publication on the website.

You will exercise your right of withdrawal / cancellation within the deadline if you send your notice of withdrawal / cancellation before the expiry of the deadline indicated above.

Please note that you may not exercise your right of withdrawal / cancellation in the cases provided for in Article 29 of Government Decree 45/2014 (II.26.), but in particular:

- in case of a perishable products or product with a short shelf-life,

- in case of a sealed product which, for reasons of health or hygiene, cannot be returned if opened after delivery.

 

Legal effects of withdrawal / cancellation

If you withdraw from this contract, we will reimburse you immediately, but no later than 14 days after receipt of your notice of withdrawal, for any products and services you have reimbursed, including shipping costs (but excluding any additional costs incurred as a result of your decision to chosen a mode of transport other than the cheapest standard mode of transport). For a refund, we will use the same method of payment as the one used in the original transaction, unless you have expressly agreed to use another method of payment; you will not incur any additional costs as a result of using this refund method. We may withhold a refund until we have received the return, or you have confirmed that you have returned it: the earlier of the two dates must be taken into account.

You must return or return the product to us without undue delay, but no later than 14 days from the date of notification of your withdrawal. The deadline is considered to have been met if you return the product before the 14-day deadline.

The cost of returning the product is borne by the Buyer, which will be reimbursed by the Seller if the legal conditions are met. You can only be held liable for any depreciation of the product if it has occurred as a result of an excess use compared to what is required to determine the nature, characteristics and functioning of the product.

  1. Supplies Warranty

In what cases can the Buyer exercise his/her right for supplies warranty?

In the event of defective performance, the Buyer may enforce a claim for supplies warranty against the company in accordance with the rules of the Civil Code.

What rights do you have based on your supplies warranty claim?

You can choose to opt for the following supplies warranty claims:

You can request a repair or replacement, unless it is impossible to meet the demand of your choice, or it would entail a disproportionate additional cost for the business compared to meeting another demand. If you have not requested or could not request the repair or replacement, you may request a pro rata reduction of the costs, or have the defect rectified at the company's expense, or have someone else repaired or, ultimately, withdraw from the contract.

You can transfer from your chosen supply warranty to another, but the cost of the transfer is borne by the buyer, unless it was justified or offered by the seller.

What is the deadline for claiming a supply warranty?

The buyer is obliged to report the defect immediately after its discovery, but not later than within two months from the discovery of the defect. However, you may no longer exercise your warranty rights beyond the two-year limitation period from the performance of the contract.

To whom can you enforce your warranty claim?

The supply warranty claim can be enforced against the seller.

What are the other conditions for enforcing your warranty rights?

Within six months of the fulfillment of the order, there are no conditions other than the notification of the defect to enforce your warranty claim if you prove that the product or service was provided by the Seller. However, six months after the fulfillment of the order, the buyer must prove that the defect he or she recognized was already present at the time of performance.

  1. Product Warranty

In which case can you exercise your product warranty rights?

In the event of a defect in a movable property (product), you may, at your option, enforce the right or product warranty claim specified in point 1.

What rights do you have based on your product warranty claim?

As a product warranty claim, you can only request the repair or replacement of a defective product.

In which case is the product considered defective?

A product is defective if it does not meet the quality requirements in force at the time of placing it on the market, or if it does not have the characteristics specified by the manufacturer.

What is the deadline for claiming a product warranty?

A product warranty claim can be enforced within two years of the product being placed on the market by the manufacturer. At the end of that period, that entitlement shall lapse.

Against whom and under what other conditions can you assert your product warranty claim?

You can only make a product warranty claim against the manufacturer or distributor of the movable property. The defect of the product must be proven by the customer in the event of a product warranty claim.

In which cases is the manufacturer (distributor) exempted from its product warranty obligation?

The manufacturer (distributor) is only exempted from its product warranty obligation if he can prove that:

  • the product was manufactured or marketed in the course of his non-business activities, or
  • the defect was not recognizable in the light of current scientific and technical knowledge at the time of placing it on the market, or
  • the defect of the product results from the application of a legislation or a mandatory official regulation.

It is sufficient for the manufacturer (distributor) to prove only one reason for the exemption.

Please note that due to the same defect, the supply warranty and product warranty claim cannot be enforced simultaneously, in parallel. However, if the product warranty claim is successfully enforced, the supply warranty claim for the replaced product or repaired part can be enforced against the manufacturer.

 

  1. Guarantee

In what cases can you exercise your right for supplies warranty?

In case of incorrect performance, pursuant to government decree 151/2003, the Seller is obliged to provide a guarantee.

 

What rights do you have under the guarantee and within what period?

You can request a repair or replacement, unless it is impossible to meet the demand of your choice or it would entail a disproportionate additional cost for the business compared to meeting another demand. If you have not requested or could not request the repair or replacement, you may request a pro rata reduction of the costs, or have the defect rectified at the company's expense, or have someone else repaired or, ultimately, withdraw from the contract.

You can transfer from your chosen supply warranty to another, but the cost of the transfer is borne by the buyer, unless it was justified or offered by the seller.

When is the business exempt from its obligation of guarantee?

The company is only exempt from the guarantee obligation if it proves that the cause of the defect arose after the fulfillment of the order.

Please note that due to the same error, the supply warranty and the guarantee claim, as well as product warranty and guarantee claim cannot be enforced at the same time, in parallel, otherwise the rights arising from the guarantee are independent of the rights allowed in points 1 and 2.
